New Texas Auto Auction Services v. Gomez de Hernandez, 06-0550

In a case involving auctioneering of a defective car, the court of appeals decision holding an auctioneer could be liable for claims of strict liability and negligence under products liability law is reversed, where section 402A of the Second Restatement of Torts does not apply when the auctioneer does not sell automobiles for its own account and no legal duty to discover and remedy unknown dangers exists.
