City of Dallas v. Dequire, 06-0543
In an action arising under a breach of contract dispute for violation of the City's civil service rules and written Police Department policy, a court of appeals decision holding that the City's request for attorney fees was an affirmative counterclaim waiving immunity from suit is reversed where the Court's first opinion in Reata Constr. Corp. v. City of Dallas, upon which the court of appeals based its decision, was withdrawn and replaced (see Reata Constr. Corp. v. City of Dallas, 197 S.W.3d 371 (Tex. 2006).)
