Mission Independent School District v. Garcia et. al., 05-0734

The Tort Claims Act's election-of-remedies provision under Tex. Civ. Prac. & Rem. Code section 101.106 applies to bar common-law claims for discriminatory dismissal against the Independent School District , but does not bar common-law claims under the Texas Commission on Human Rights Act, Tex. Lab. Code section 21.001-21.556.
