Bowden v. Phillips Petroleum Co., 03‑0824

In an action to collect for underpayment of oil and gas royalties under lease, a court of appeals judgment reversing a trial court's certification of certain subclasses of royalty owners is affirmed where individual issues would predominate. However, the court of appeals' judgment decertifying another subclass is reversed where the court of appeals erred in finding that the gas royalty agreements were ambiguous.
