Supreme Court of Texas
Houser v. McElveen, 06-0504
In a pro se inmate's suit for mandamus compelling respondent-county clerk to probate his father's will, a decision dismissing inmate's appeal is reversed and remanded where petitioner was entitled to an extension of time in which to file his notice of appeal, and thus the court of appeals should not have dismissed the appeal.
