Springer v. Springer, 06-0382
In divorce proceedings, dismissal of husband's appeal for failing to file an affidavit of indigence "with or before" the notice of appeal, as required by Tex. R. of App. Proc. 20.1(c)(1), is reversed as the failure to file such affidavit will not support dismissal unless the appellant is given a reasonable time to correct the defect and fails to do so.
