In an action brought against the operators of a county landfill alleging that the vertical expansion of the landfill breached a settlement agreement between the parties, petitions for review of a court of appeals decision reversing an injunction against the operators and awarding respondent damages are denied, but the court notes that a footnote in the court of appeals' opinion was outside the issues before it and thus it could not determine the validity of a discharge permit issued to operators.
