Nat'l Plan Admins., Inc. v. Nat'l Health Ins. Co., 05-0006
In a suit arising after respondent contracted with petitioner for it to perform third-party administrator duties for cancer insurance policies issued by respondent, and after respondent exited the cancer insurance market petitioner "rolled" most of the cancer policies to another insurer, a jury finding that petitioner breached its general fiduciary duty to respondent is reversed as petitioner did not owe respondent a general fiduciary duty.
