In re Merrill Lynch Trust Co. FSB, 03-1059

In an action brought against Merrill Lynch and others alleging breach of fiduciary duty, fraud, and other claims related to financial services plaintiff received, Merrill Lynch's petition for mandamus relief challenging a refusal to compel arbitration and stay litigation is conditionally granted where the trial court abused its discretion in refusing to compel arbitration with other parties, and in refusing to stay the litigation against an affiliate, for the reasons set forth in In re Merrill Lynch Trust Co., __ S.W.3d__ (Tex. 2007).
