Fort Worth Indep. Sch. Dist. v. Serv. Employment Redev., 05-0427

In a suit for breach of a contract to provide alternative education program services, a court of appeals decision holding that defendant-district's immunity from suit was waived by section 11.151(a) of the Texas Education Code is reversed and remanded where, although section 11.151 is not a clear and unambiguous waiver of immunity, further proceedings were needed to determine whether recently enacted statutory sections would waive immunity in the case.
