S. Texas Water Auth. v. Lomas, 05-0855
In a declaratory-judgment and damages action against the South Texas Water Authority (STWA) challenging operating expenses charged under a water-supply contract with a city, a court of appeals ruling partially reversing summary judgment for defendant-STWA is reversed where the court of appeals erred in holding that individual plaintiff had individual standing to pursue monetary and declaratory relief, plaintiff-organization had associational standing to pursue declaratory relief, and that both parties had standing as third-party beneficiaries of the water supply contract.
