City of Galveston v. State of Texas, 04-0890
In a dispute over whether Galveston taxpayers rather than Texas taxpayers should bear the cost of certain roadway repairs, the trial court's dismissal of the state's suit against the city is affirmed where, without the Legislature's clear and unambiguous consent, the state lacked the authority to waive immunity from suit for the city.
