A petition for writ of mandamus, which challenged denial of bank's motion to compel arbitration of claims involving allegedly forged checks filed by one of its customers, is conditionally granted where the trial court abused its discretion in denying the motion to compel as: 1) a valid arbitration agreement existed between the parties; 2) the dispute fell within its scope; and 3) the bank did not waive its right to arbitration.
