Hood v. Wal-Mart Stores, Inc., 05-0902
In an assault and battery action against Wal-Mart and employees alleging plaintiff was assaulted when the employees grabbed his arm as he attempted to exit a store with a television set, dismissal of plaintiff's appeal from an adverse summary judgment ruling is reversed where plaintiff's affidavit of indigence discharged the filing fee requirement unless a contest to it is sustained.
