In a 42 U.S.C. section 1983 case brought by a deputy who was not resworn after a new constable took over, the court rules that plaintiff's substantive due process claims failed for the same reasoning as in another case decided today, County of Dallas v. Wiland, ___ S.W.3d ___ (Tex. 2007), but his procedural due process claim was valid because, like the deputies in Wiland, he was denied a hearing before the civil service commission on his grievance.
