Tony Gullo Motors I, L.P. v. Chapa, 04-0961
A decision reinstating an award for plaintiff with modification in an action brought against a car dealer for breach of contract, fraud, and the Texas Deceptive Trade Practices-Consumer Protection Act, is reversed where, although plaintiff could assert her claim in several forms, she could not recover in all of them, and further, the court of appeals- judgment included exemplary damages exceeding the bounds of constitutional law and attorney-s fees exceeding the bounds of Texas law.
