Supreme Court of Texas

In the Interest of H.R.M., 06-0270

A court of appeals' reversal of an order terminating an incarcerated father's parental rights is reversed where: 1) the court of appeals misapplied the pertinent evidentiary standard and erred in disregarding evidence that supported the jury's finding that the father would be incarcerated for at least two years; 2) he did not provide care for the child by leaving her with mother; and 3) the record did not support his ineffective assistance of counsel claim.
