Lexington Ins. Co. v. Strayhorn, 04-0429
In a tax refund case arising from the comptroller's assessment of premium taxes against certain insurers for certain policies, a judgment against the insurers remanding the case to the trial court is affirmed where, although the Texas Insurance Code distinguishes between eligible surplus lines carriers and other unlicensed insurers, and often treats the two differently, if a policy is procured from an eligible surplus lines carrier without a licensed agent, the premium tax applicable to unauthorized insurance policies may be collected from the insurer.
