W. Steel Co. v. Altenburg, 05-0630
In a personal injury case where a workers- compensation policy was asserted as a bar to the action, a court of appeals judgment ruling that defendant was not entitled to the affirmative defense under the Texas Workers' Compensation Act is reversed and remanded where the existence of the defendant's workers' compensation policy was undisputed, and the court of appeals erred in not finding so and failing to address the matter at issue on appeal.
