Supreme Court of Texas
Larson v. Downing, 05-0155
A doctor's petition for review challenging the reversal of a trial court's exclusion of plaintiff's expert testimony in a medical malpractice case is granted since the trial court did not abuse its discretion in excluding the expert's testimony where it had been fifteen years since he had performed surgery like that performed by the defendant.
