Chair King, Inc. v. GTE Mobilnet of Houston, Inc., 04-0570

Texas did not otherwise permit a cause of action for the receipt of unsolicited fax advertisements until September 1, 1999. Thus, plaintiffs had no actionable claim under the Telephone Consumer Protection Act for receiving illegal faxes from various companies advertising their products since those faxes were sent before that date.
