SHELL OIL CO. v. HRN, 03-0555

Plaintiff's suit, alleging that defendant's pricing practices are an attempt to drive it out of business, is dismissed where defendant established as a matter of law that its price was fixed in good faith as defined in section 2.305(b) of the Texas Business and Commerce Code.
