INTERSTATE CONTRACTING CORP. v. CITY OF DALLAS, 03-0152
Texas recognizes pass-through claims, i.e., a contractor may assert a claim against an owner on a subcontractor's behalf despite no privity of contract between subcontractor and owner. The contractor must remain liable to the subcontractor for damages sustained by the subcontractor.
