Supreme Court of Texas

SIXTH RMA PARTNERS, L.P. v. SIBLEY, 02-0179

Sufficient evidence showed that a limited partnership used an alternate name as an assumed name, so that an original petition filed under the assumed name was effective to commence suit on behalf of the partnership. Second supplemental pleadings were effective to substitute a correct legal name.
