BRISCOE v. GOODMARK CORP., 02-0498

Under the law of the case doctrine, the court of appeals had authority to reconsider its first dismissal of an appeal, and to change that first decision if clearly erroneous, but the court should not have dismissed a second appeal for want of jurisdiction, but rather should have considered the merits of the first appeal.
