FIRST NAT'L BANK OF SEMINOLE v. HOOPER, 01-0688
Where an insolvent debtor conveyed a deed of trust lien to further secure a valid antecedent debt, and the underlying property's value far exceeded the debt secured, such transfer cannot support a Texas Uniform Fraudulent Transfer Act constructive fraud claim absent evidence that the transferee intended to assist the debtor in evading his creditors.
