HENRY SCHEIN, INC. v. STROMBOE, 00-1162
Because plaintiffs who purchased faulty dental practice management software products failed to demonstrate, as Rule 42(b)(4) requires they must, "that the questions of law or fact common to the members of the class predominate over any questions affecting only individual members, and that a class action is superior to other available methods for the fair and efficient adjudication of the controversy," the class is decertified and remanded to the district court.
