TEXAS HOME MGMT., INC. v. PEAVY, 00-0889

Because plaintiff, an intermediate care facility for the mentally retarded, did not establish as a matter of law that it had no duty to reasonably exercise its right to control one of its residents, who murdered a person, the trial court erred in granting summary judgment in plaintiff's favor.
