Supreme Court of Texas

CARPENTER v. CIMARRON HYDROCARBONS CORP., 01-0002

Where civil procedure rules provided the plaintiff opportunity to obtain leave to file a late response to a summary-judgment motion, the court erred in applying an equitable standard to plaintiff's motion for new trial, and where plaintiff did not show good cause, a motion for leave to file a late summary-judgment response is denied.
