TRAVIS COUNTY, TEXAS v. PELZEL & ASSOC., INC., 01-0036

Local Government Code section 89.004 does not waive county's sovereign immunity from suit, and where county's conduct did not waive its immunity, a claim for improper withholding of full payment under a construction contract is dismissed for lack of jurisdiction.
