Supreme Court of Texas

S.W. ELEC. POWER CO. v. GRANT, 00-0625

The Uniform Commercial Code (UCC) does not apply to a public utility's tariff provision limiting liability for personal injury resulting from the utility's ordinary negligence; therefore, the limitation on liability is not prima facie unconscionable under the UCC.
