BRAGG v. EDWARDS AQUIFER AUTHORITY, 00-0436

Defendant's adoption of well-permitting rules falls within the exception to the Private Real Property Rights Preservation Act (PRA) for actions taken under a political subdivision's statutory authority to prevent waste or protect rights of owners of interest in groundwater, and the Authority's proposed actions on plaintiffs' permit applications constitute "enforcement of a governmental action," to which the "takings impact assessments" requirement of the PRA does not apply.
