TEX. DEP'T OF TRANSP. v. GARZA, 00-0948

A street sign that accurately reflects a speed limit argued to be too high considering the sign-s proximity to a school zone is not a "condition" triggering the Texas Tort Claims Act's waiver of sovereign immunity for claims of "personal injury and death so caused by a condition or use of tangible personal or real property." Tex. Civ. Prac. & Rem. Code - 101.021(2).
