CITY OF HARLINGEN v. THE ESTAE OF DAVID J. SHARBONEAU, 99-1118

In public taking cases, subdivision development analysis to determine a property's value is not admissible if it only determines what a developer could hypothetically afford to pay to profitably subdivide the property, not what it would pay in the competitive, risk-filled marketplace.
