Court of Criminal Appeals of Texas

Ex Parte Martinez, AP-76,413

Defendant's petition for habeas relief from her conviction for capital murder and a sentence of life imprisonment, is denied as, defendant has failed to demonstrate that she received ineffective assistance of counsel as there was ample evidence to support a reasonable jury's finding of guilt and it is unlikely, in the face of all the evidence with which the jury was presented, that the jury would have reached a different conclusion in the absence of the gang-related evidence.
