Court of Criminal Appeals of Texas

Menefee v. State, PD-1530-08

Defendant's drug conviction is reversed, where a sworn acknowledgment that a defendant is opting to plead "guilty" to the charged offense (without expressly admitting that the charges are "true and correct") is not equivalent to a judicial confession, and thus Defendant's guilty plea was insufficient to sustain a conviction.
