Wasylina v. State of Texas, 051907

Acquittal of conviction for criminally negligent homicide is reversed where: 1) proving the greater culpable mental state of recklessness necessarily proved the lesser culpable mental state of criminal negligence; and 2) the court of appeals erred in holding that the State failed to prove criminal negligence because it proved only recklessness.
