Shepherd v. State of Texas, 1551-07

Affirmation of denial of motion to suppress evidence and conviction for possession of marijuana are affirmed where police entry into defendant's house upon finding the front door open, believing that a burglary may have occurred, justified under the emergency doctrine the seizure of a bag of marijuana lying in plain view in the living room.
