Court of Criminal Appeals of Texas

Flores v. State of Texas, 0265-07

A conviction for murdering defendant's pregnant girlfriend's twin fetuses by stepping on her abdomen is affirmed where the capital murder statute is constitutional, and the court of appeals did not err in ruling that he was not entitled to a jury instruction on the lesser-included offense of deadly conduct.
