Madden v. State of Texas, 1243-05

A court of appeals decision reversing a conviction for possession of cocaine with intent to deliver is vacated where, contrary to the appeals court's ruling, defendant was not entitled to an Article 38.23(a) jury instruction concerning whether a trooper had reasonable suspicion to continue his detention because no evidence raised a disputed fact issue material to the admissibility of the challenged evidence.
