State of Texas v. Colyandro, 826-06
A court of appeals' judgment upholding a trial judge's decision to quash the Election Code-based conspiracy charges against Tom Delay and other defendants is affirmed where: 1) the holdings in Moore v. State, 545 S.W.2d 140 (Tex. Crim. App. 1976), and Baker v. State 547 S.W.2d 627 (Tex. Crim. App. 1977) cannot be restricted to offenses defined in the Controlled Substances Act; and 2) the interpretation of Penal Code section 1.03(b) of the Penal Code in those cases was correct.
