Volosen v. State of Texas, 0492-06
A decision reversing a conviction for cruelty to animals, arising from circumstances in which defendant-veterinarian struck a neighbor's dog and killed it when it was in his yard with his chickens, is reversed as, under the circumstances, defendant failed to meet his burden of production to show the applicability of his claimed defense under Health and Safety Code section 822.033.
