Court of Criminal Appeals of Texas

Stuhler v. State of Texas, 1723-05

Reversal of a conviction for injury to a child is affirmed where the evidence regarding the child's constipation did not support a jury finding of serious bodily injury beyond a reasonable doubt, a disjunctive application paragraph violated appellant's right to a unanimous jury verdict, and such defect requires reversal of the conviction even under an egregious-harm standard of review.
