A capital murder conviction and death sentence are affirmed over meritless points of error regarding: 1) the sufficiency of the evidence; 2) the constitutionality of Tex. Code Crim. Proc. Article 37.071; 3) admission of evidence; 4) denial of a motion for a mistrial after the jury heard extraneous offense evidence at the guilt-phase of trial; 5) denial of defendant's Sixth Amendment right of confrontation; 6) exclusion of evidence in the form of an excited utterance; 7) denial of a motion for mistrial after the state allegedly failed to correct false testimony; 8) a Brady claim; 9) improper denial of a mistrial motion made after certain speculative testimony; and 10) erroneous denial of a motion for a new trial.
