Court of Criminal Appeals of Texas
Buchanan v. State of Texas, 0006-06
In an aggravated robbery case, a court of appeals' ruling that defendant's arrest violated Chapter 14 of the Texas Code of Criminal Procedure and that any evidence obtained as a result of that arrest should have been suppressed is reversed where a pretrial motion to suppress based upon constitutional principles, along with argument made to the trial court in support of that motion, was not sufficient also to preserve error under Chapter 14 of the Texas Code of Criminal Procedure.
