Court of Criminal Appeals of Texas

Ex parte Martinez, 75,086

In a capital murder and death penalty case, a petition for habeas relief is denied over claims that he received ineffective assistance of counsel at the punishment phase of trial due to: 1) a failure to investigate and present a statutorily recognized mitigating defense of temporary insanity resulting from drug intoxication; and 2) a failure to conduct an adequate investigation of mitigating evidence relating to physical, emotional, and sexual abuse and neglect in applicant's background.
