Guzman v. State of Texas, 1863-04

A conviction and sentence for attempted murder is affirmed where, in view of the evidence of the case at hand, defendant was not entitled to an instruction on deadly conduct despite a claim that defendant intentionally pulled the trigger on a gun he believed was unloaded.
