Bitterman v. State of Texas, 633-04

Dismissal of plaintiff's appeal from a denial of his motion for a new trial for aggravated sexual assault based on the state's breach of his plea agreement is vacated where the court of appeals erred in concluding that because defendant did not object at his sentencing hearing, it could not consider his claim.
