Court of Criminal Appeals of Texas

GUTIERREZ v. STATE OF TEXAS, 358-02

In the context of community supervision revocation proceedings, the law does not give a probationer the right to withdraw a plea after sentencing, and because appellant had no right to withdraw his plea, an ineffective assistance claim fails where his attorney was under no obligation to make a request to withdraw the plea.
