Court of Criminal Appeals of Texas

FULLER v. STATE OF TEXAS, 1283-98

The victim's name is not a statutory element of the offense of "injury to an elderly individual," and where there was no indication the defendant was surprised by the proof at trial, the prosecution's failure to prove the victim's name exactly as alleged in the indictment did not make the evidence insufficient to support conviction.
